#partial EnglandResidentialSDLT


The  #partial EnglandResidentialSDLT data helper can be used to calculate current land tax rates for England and Northern Ireland.

If you are calculating land tax rates for Wales or Scotland, please use the #uksdlt helper instead.

The data helper is made up of the following parts:

The data markers used in the example above can be changed for any current data markers in use within your InTouch account.

#partial EnglandResidentialSDLT

The data helper that tells InTouch to perform an SDLT calculation.

any.purchasers.non.uk.resident

A data marker representing whether the purchaser is a non UK resident.

individual.purchaser

A data marker representing whether the property is being purchased by an individual.

is.second.property

A data marker representing whether the purchase of the property will result in them owning two or more properties.

property.residence.replacement

A data marker representing whether the property will be replacing their main residence.

previous.property.ownership

A data marker representing whether the purchaser has ever owned or part owned property.

property.main.residence

A data marker representing whether the property will be the purchasers main residence.

property.price

A data marker representing the price of the property.

effective.date

A data marker representing the effective date of the transaction

This can be used to output the correct Stamp Duty rates depending on when the transaction is due to complete

Quote Calculators

To calculate SDLT within a quote calculator:

  1. Create the following questions to collect the required information:

    Are any of the purchasers non-UK resident?

    What is meant by non-UK resident

    • Non-UK resident as an individual
      You are treated as non-UK resident for Stamp Duty Land Tax (SDLT) if you are not present in the UK for 183 days or more in the 12 months before the effective date of the purchase.
    • Non-UK resident as a company
      Corporate purchasers will be non-UK resident if they are not UK resident for Corporation Tax purposes on the purchase date.
      Special rules apply for UK resident companies which are under the direct or indirect control of persons who are not resident in the UK.
      Special rules also apply for trusts and settlements.

    Yes / No

    Are you purchasing the property as an individual?

    Choose ‘Yes’ if you’re buying on your own, or you’re married or in a civil partnership. Choose ‘No’ if you’re a company or trust.

    Will the purchase of the property result in owning two or more properties?

    Yes / No

    This question can be made conditional based on "Are you purchasing the property as an individual?" being answered "Yes".

    Is the property being purchased replacing your main residence? 

    If your previous main residence has not yet been sold choose "No". A refund may be available if the previous main residence is sold within 3 years.

    This question can be made conditional based on "Will the purchase of the property result in owning two or more properties?" being answered "Yes"

    Have you ever owned or part owned another property?

    We only need to know about residential property, or property that has both residential and non-residential use. This includes freehold property, or leasehold property of at least 21 years. Select yes if you either; bought a property, inherited a property, are a beneficiary of a trust that owns a property.

    Yes / No

    This question can be made conditional based on "Will the purchase of the property result in owning two or more properties?" being answered "No".

    Will this property be your main residence?

    Yes / No

    This question can be made conditional based on "Have you ever owned or part owned another property?" being answered "No".

    Property Price

    This is the chargeable consideration.

    Currency

    [Optional] Effective date of your transaction

    This is usually the completion date.

    Date

  2. Save the answers back to the relevant data markers
  3. Create the following fee including the #partial EnglandResidentialSDLT data helper within the fee calculation box:

Remember to change the data markers in the example above to the data markers used within your form.
April 2025 Rates

With the Stamp Duty rates set to change in April 2025, configure your calculators with either of the below to output the correct rates for your transactions:

  1. Effective Date
    Add a new question to your calculator asking the user for the Effective Date of the transaction.
    This will be used to determine whether the pre or post April 2025 rates should be used within the Stamp Duty calculation.
    Within your Stamp Duty calculation, add the data marker representing the Effective Date to the end of the helper. For example: {{#partial EnglandResidentialSDLT any.purchasers.non.uk.resident individual.purchaser is.second.property property.residence.replacement previous.property.ownership property.main.residence property.price effective.date}}
  2. Post April 2025 Rates
    If you wish to only output the post April 2025 rates, amend your current Stamp Duty calculation to the following: {{#partial EnglandResidentialSDLT any.purchasers.non.uk.resident individual.purchaser is.second.property property.residence.replacement previous.property.ownership property.main.residence property.price "2025-04-01T00:00:00Z"}}
    If using this method, please just be aware that the date entered into this helper will need amending to reflect any future rate changes.

Templates

The #partial EnglandResidentialSDLT data helper can also be used in document and email templates to calculate current SDLT rates directly within the template. 

  1. Ensure the relevant data markers are defined as custom fields on your matter templates
  2. Add the data helper to the relevant place within the template
  3. When the template's generated on a matter, the user will be asked the relevant questions and the SDLT will be automatically calculated
